LIMITATION OF LIABILITY

Erickson Cycle Tours, Inc., its owners, agents, employees and affiliated companies, hereby give notice that they act only as agents for hotels, transportation companies, and operators, and suppliers of travel services, and assume no responsibility whatsoever in connection with the operation or service of any aircraft, motor vehicle, boat, other conveyance, inn, lodge, or hotel which may be used wholly or in part, for services to Erickson Cycle Tours tour participants. Erickson Cycle Tours, its operators, airlines, and agents will not be responsible for any act, error, or omission, nor for any injury, loss, accident, delay, inconvenience, irregularity, or damage which may be occasioned by any cause whatsoever, including acts of nature, civil disturbance, government restrictions, or failure of any means of a conveyance to adhere to published schedule. Erickson Cycle Tours reserves the right prior to departure, and after departure, to re-price, cancel, or withdraw any tour for any reason whatsoever, and to alter or omit any part of the itinerary, to substitute hotels or leaders, or to change any means of conveyance without notice, and without allowance of refund, with the liability of increased costs – if any – to be borne by the tour participants. If the trip is cancelled due to acts of insurrection, strikes, acts of God, or any other cause beyond the control of Erickson Cycle Tours, refunds will be based on the difference between the original tour price and the cost of services already provided. Erickson Cycle Tours reserves the right to accept or reject any person as a tour participant at any time.

PARTICIPANT RESPONSIBILITY

Tour participants assume the responsibility to select/design a tour most appropriate to their physical abilities and interest. Participants are responsible for being in sufficient good health to undertake their trip and may be required to obtain a physician’s release to participate in the tour. Participants are also responsible for studying all pre-departure information; for bringing all detailed equipment and clothing; for acting in a manner considerate of fellow tour participants and the countries visited. Smoking is not permitted in passenger vans. The participant is presumed to have the knowledge and bicycling riding and handling skills necessary to participate in the tour they have chosen. No liability shall attach to Erickson Cycle Tours, its owners, agents, or employees for failing to instruct the participant in bicycle riding or handling skills or local traffic laws, but the participant shall follow any written or verbal instructions that are given regarding the same.

AIRLINE RESPONSIBILITY

The airlines concerned are not to be held responsible for any act, omission, or event during the time the passenger is not on board their planes or conveyances. The passenger contract in use by the airline concerned, when issued, shall constitute the sole contract between the airline and purchaser of their programs and/or passenger.

CANCELLATION

If you cancel your trip, the following charges apply: Non-refundable cancellation fee (if cancelled after January 1): $800.00 31-60 days before departure: 50% of tour cost 30 days or less before departure: no refund Credit card processing fees will be deducted from any payment to be refunded that was done by credit card. YOU WILL NOT BE CONFIRMED ON THE TOUR UNTIL YOU HAVE SIGNED THE RELEASE FORM IN FULL VOLUNTARY PARTICIPATION: I acknowledge that I have voluntarily applied to participate in the tour designated on this application and that I have read the description of the trip as it appears, together with the information contained in this application. I am voluntarily participating in this tour with knowledge of the hazards involved.

ASSUMPTION OF RISK

I am aware that adventure travel, particularly bicycling, such as that which I am undertaking, may involve hazardous activities in remote areas of Europe with risk of illness, injury, or death, which may be caused by forces of nature, the negligence of Erickson Cycle Tours, its affiliated organizations, and their employees, or some agencies known or unknown. I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time I am participating in this tour. In order to partake of the excitement and enjoyment of this adventure travel tour, I am willing to accept the risk and uncertainty involved as being an integral part of my adventure. I hereby accept and assume full responsibility for any and all risks of illness, injury, or death, due to the negligence (but not reckless, willful, or fraudulent conduct) of Erickson Cycle Tours, its employees, officers, directors, agents, contractors, or affiliated organizations or any of their employees. In consideration of my being permitted to participate in this tour, I agree to assume all risks of illness, injury, or death, and agree not to sue, and to release from liability and indemnify Erickson Cycle Tours, their owners, officers, agents, employees, and other persons or entities involved with this tour, from all actions, claims, or demands for injury or damage regardless of the cause, resulting from my participation in the tour. I have carefully read the Erickson Cycle Tours Limitations of Liability. I have familiarized myself with all information provided to me about this tour, and I agree to all stated conditions set forth in the Limitation of Liability, specifically including the section outlining my responsibilities and obligations as a tour participant. I have carefully read this agreement. I understand that it is a release of liability and a contract between myself and Erickson Cycle Tours and/or its affiliated organizations, and I sign this agreement of my own free will. * If I am signing on behalf of a minor, in addition to the above, I also agree to release, hold harmless, and indemnify the entities named above for any claims of the minor. I agree to be responsible for any medical expenses incurred by the minor.
